Private and confidential resolution of disputes

Arbitration is private determination of a dispute, by an independent third party. Parties either agree on the appointment of the arbitrator or application can be made to an Authorised Nominating Authority.

The arbitrator can only determine the specific matters that are claimed by the parties and makes a decision after considering the representations of the parties. The arbitrator's decision is called an award and is normally final and binding on the parties. The award is written and is enforceable by the courts.

The Arbitration Act 1996 and its amendments contain statutory provisions that govern the arbitration process.

Arbitration will be conducted in accordance with the AMINZ Code of Ethics and the AMINZ Arbitration Protocol.
